Terms & Conditions — Joe Photography & Safaris

These Terms and Conditions govern your use of the website joekphotography.co.ke and the services offered by Joe Photography & Safaris (“we”, “us”, “our”). By accessing our website or booking our services, you agree to these terms.
1. Services
Joe Photography & Safaris provides the following services across Kenya and East Africa:
- Professional photography (corporate, wedding, product, hotel, documentary)
- Videography and cinematic production
- Drone and aerial photography (KCAA licensed)
- Live streaming and event broadcast
- Safari and wildlife photography tours
- Tour van and Land Cruiser hire
- Wildlife photography prints and digital downloads (Shop)
2. Bookings & Deposits
- All service bookings require a 50% non-refundable deposit to secure the date
- The remaining balance is due on or before the day of the event/service
- Bookings are confirmed only upon receipt of the deposit
- We recommend booking 2–4 weeks in advance for standard events and 4–6 weeks for large corporate conferences
- For safari packages, full payment or agreed instalment schedule applies
3. Cancellations & Refunds
- Cancellation 14+ days before event: Deposit forfeited; no further charge
- Cancellation 7–13 days before event: 75% of total fee payable
- Cancellation within 7 days of event: 100% of total fee payable
- Force majeure (natural disasters, government restrictions, death in immediate family): We will reschedule at no additional charge where possible
- Shop purchases: Digital downloads are non-refundable. Printed products may be returned within 14 days if damaged in transit
4. Copyright & Image Rights
- All photographs and videos produced by Joe Photography & Safaris remain the intellectual property of Joe Photography & Safaris unless a full rights transfer is agreed in writing
- Clients receive a personal use licence for images delivered unless a commercial licence is purchased separately
- We reserve the right to use images for our portfolio, website, and marketing unless the client requests otherwise in writing before the shoot
- Wildlife prints purchased from our Shop are licensed per the product listing (personal, editorial, or commercial)
- Reselling, sublicensing, or reproducing our images without permission is prohibited
5. Delivery of Work
- Edited photos from corporate and event shoots are delivered within 3–5 business days
- Wedding galleries are delivered within 2–4 weeks
- Safari galleries within 1–2 weeks
- Specific timelines will be confirmed in writing at the time of booking
- Delivery is via online gallery link (Google Drive, WeTransfer, or similar)
6. Drone Operations
- All drone operations are conducted by KCAA-licensed pilots with public liability insurance
- Drone flights are subject to Kenya Civil Aviation Authority regulations and airspace approvals
- We cannot guarantee drone coverage where regulatory approval is denied or weather conditions are unsafe
- Restricted airspace (airports, government zones, national parks where prohibited) will not be overflown
7. Safari & Tour Services
- Safari itineraries are subject to change due to weather, park conditions, or animal movement
- We are not liable for circumstances beyond our control including flight delays, road conditions, or wildlife behaviour
- Travel insurance is strongly recommended for all safari clients
- Park entry fees, accommodation, and tips are as specified in the package; changes in park fees are passed on at cost
8. Live Streaming
- We guarantee best-effort internet connectivity using our 4G/5G bonding equipment plus venue internet
- We are not liable for stream interruptions caused by third-party internet service failure beyond our equipment’s capacity
- Platform-specific technical issues (YouTube Live outages, Facebook Live restrictions) are outside our control
9. Limitation of Liability
Our liability is limited to the total fee paid for the specific service. We are not liable for indirect, incidental, or consequential damages. In the unlikely event of equipment failure preventing delivery, our maximum liability is a full refund of the amount paid.
10. Governing Law
These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved under Kenyan jurisdiction.
11. Amendments
We reserve the right to update these Terms at any time. Continued use of our services after updates constitutes acceptance of the revised Terms.
